Here's a link to a presentation that IV prepared in May for lawmakers. Page 13 has visa availabilities for indians in FY05. Take a look.. The slides has made a strong case with lots of facts compiled together. You can present the slides to your lawmakers or their staff, or the media if you get a chance..

ok........ After thinking about it for a while, I think I have the answer now.
What zephyrr is saying is that you should be able to show that your promotion is a new job in itself and it is significantly different from the job you were doing prior to your filing for Green Card, although it might be in the same company.

I-140 receipt will not have A#. Only approval notice will have it. In the beneficiary column along with name of the person.

Once you strart using EAD your H1 will be terminated. If you want to switch to H1 again your need to apply for fresh H1 in the new quota. You cant renew because its terminated.

It should not be subject to the annual cap unless you have been out of the U.S. for at least one year since you were last in H-1B status.
