    I believe i am right when I say that one can work on an expired H1b visa provided his/her extension (I129) is pending approval!! Please correct me if wrong.

    Don't ignore Dubai. It is a boom town and will give red carpet welcome to your wife because she is a US trained doc. I know of a few Indian docs who were on J1 visa and never got waiver jobs went to work in Dubai instead because with US degree they can practise there without any major issues. Dubai is good for IT folks too with the internet city. You may want to google and find more about Dubai's requirements.

    Calling up Customer service fixed it. My card did arrive a month+ after my spouse. there was some problem with production of my card first time around.

    China EB3 also didn't recieve the fair share (as per the law) of annual quota.

    Looks like USCIS doesn't follow any rules whatsoever. They do whatever they like and nobody question them.

    hello days go by,
    kinda new here.
    is there a way to find out, out of 360K case overall, how many are EB1, EB2 or EB3? Or how many files in year 01, 02, and 03?

    overheard most are EB2/3 cases and not many 245i cases.

    One thing for sure is that no file in BEC is EB1. The rest is all guess:

    If the historic information can tell the present and future, then roughly for every 2 - 3 EB3, there is one EB2...

    The trackers at immigrationportal show not many 01 files left, and there're still quite some 02 and a lot of 03 in both BECs. DBEC tends to process a lot of 04/05 cases recently in LIFO manner, whereas PBEC is a bit more FIFO recently barring some cases that came out of regionals..

    Also, one should know we are not getting help from our group, I know many guys who are effected by GCs in my office in my neighbourhood, I can't even get them to make one call to senator office,

    how do you expect some other organization to help us, when we can't help ourselves

    People make fun of me and call me "Immigration specialist" when I take up this issue with them. No one understands the complexity of the situation and no one wants to talk about it. But I am sure many actually monitor these sites for some news they want to hear and pretend to be silent.
    No one wants to contribute for a good cause but want to reap benefits when others work hard for it

    From what I understand, if you have an H1b extended based on your Labor or I140 approval, if your I485 is denied, all applications/extensions based on your Adjustment of Status also expire.

    From the lawyers' perspective, all of them promoting H1bs is more a business push than a 'favorable situation for the applicant' push.
    Most EAD/AP applications/renewals are now filed by applicants directly, whereas H1Bs go thru the lawyers.

    But keeping the moolah part aside, why would an EAD be invalid whereas a H1b be valid, when both are based on the Green Card application?

    Because there are no clear regulations around what happens to H1 if I-485 gets denied. But there are existing regulations that EAD becomes invalid. So being on H1 gives you an edge. You will not able to extend/transfer H1 but there is no effect on existing approved h1.

    Also even if you use EAD you can actually get back on H1 status without being counted against the quota as long as your I-485 is pending. But you will need to go out and get H1 stamped and re-enter. In this particular case, since father was primary applicant he could have sponsored new H1 w/o I-94 and get it stamped and re-enter. Not sure why lawyer did not suggest that.

    Mine approved August 2nd, Wife`s pending. May be this is one of the administrative fixes from USCIS! As primary on EAD I would have to Work in same job classification, can not stay here for long without work or open a new business. But spouse on EAD can do either one of those per my knowledge. They can allot visa number to another primary. I do not think this is the reasoning from USCIS and there has to be some other reason though such as security check. I wonder if it is smart for them to allot visa numbers to primary and secondary in 2:1 ratio. Will ease problems for lot of people.

    I am looking for some serious help and advice here , I hate to see any non-immigrant in US in my circumstances .Here some information about it , My company has sponsored my work visa , soon I entered into they customs and Immigration there is some mistake with my paper work , and they charged me and later deported me .In the middle we came to know the company has sponsored some other people B/J visas for their own benefits and officers acted so racially .when i got deported they never issued my passport back , I keep on calling them now , they always say , They can't hear , some times they mention call after 5 mins , 1hr .I am so vexed with all they do , I felt so victim in this . Please advice me can i get my passport back, and my case is in pending appeal , before I got deported


    How did you board the plane with out a passport? Which country let you in with out it?

To facilitate acceptance and processing of Form I-485 when Form I-140 has already been approved, submit a copy of the I-140 approval notice.

    Actually my I-140 was approved from TSC; 485 was sent to TSC..but the employment letter in the package was addressed to NSC....will that be a problem?

    As we wait for the Senate debate to move along, I know there is a great deal of restlessness and a desire to have something, anything happen. A need for reassurance that something will happen fast, or that provision X will be signed into law by ZZZ date.

    I am starting this thread for such questions. Otherwise we have an ever proliferating set of threads with very specific questions like "can we have provision X become its own bill and have it signed by next Friday so I can go home and stop worrying?":)

    I have a question: How many months in advance should you apply for H1 extension? Do you get extension from the date you applied or from date when your H1 expires?
    1) You can apply up to 6 months before your H1 expires.
    2) You get extension from the date your previous H1 expires.

    One of my friends AOS got rejected just because his attorney rescheduled his interview. Somehow, USCIS local office did not acknowledge his request for interview reschedule and they sent a rejection letter saying that, he did not appear for the interview so they are rejecting his application. So the bottomline is 1) Try your best to not to reschedule it 2) If you have to, make sure that USCIS acknowledges your application to reschedule it.

    did your friend then file a MTR?

    I have been reading about CIR since last 4 yrs and so far no action has been taken on this topic. Obama administration too is just good at promises! There is virtually no messiah who can help legal immigrants! Time is the only saviour of legal immigrants! So the mantra should be "wait, wait and wait..........."

    MY PD is June 2004 at Delhi consulate. Lets see what happens. Hey any one could update about PCC (Police Clearance Certificate). if my date becomes current in Aug then would not have time to go to any US consulate to get the PCC.

    In this case how we should get the PCC for consular processing:cool:
